The Collapse of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the presentation of a new 28-article proposal for ending the war appeared – briefly – to have been contained. A senior US official spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Peace Talks and Military Action

The chain of opposing developments captured the harsh reality of the recent timeframe. By day, diplomatic battles are fought: optimistic declarations are delivered from multiple capitals. Significant resources is devoted on restraining certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, war remains the primary tool for achieving "peace".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track projectile deployments from enemy soil, a capacity afforded by up-to-date information. From vantage locations, defense planes that had been deployed to engage hostile guided weapons flew past – sophisticated military planes provided to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems engaged: defensive missiles fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by Western nations. Every launch creates sudden vibrations, shaking the windows. The instant of fear quickly transforms into grim resignation: possibly the approaching threat won't strike its target this time, preventing destruction from devastation and another blackout.

Continuous Dangers

Soon after, a large-caliber weapon fired at a aerial vehicle close by, part of a rapid response unit – most likely imported technology. Unfortunately, the bullets missed the hostile drone – it pressed on overhead toward its objective.

Periodically, this continued until dawn. Kyiv greeted the morning news: several casualties, devastation and utility failures in numerous residences as a result of the evening attack. As always, everyone still went about their day – enduring hostilities. But those entire period encapsulated Ukraine's critical military reliance on Western support – a dependence that regional partners are demonstrably unable to substitute in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, discussion and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new approach from Washington follows the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They stabilise the situation but never actually achieve victory. This pattern will, no doubt, endure.

Strategic Calculations

It is tempting to accuse specific actors of persistently promoting Russian terms. But that does not seem to be the whole story. US administration operates on a assumption familiar among experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The American government presumes that it is impossible to pressure the Kremlin to surrender the territory that it already controls in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, Washington does nothing to deter Moscow, through words or deeds, from believing that the situation will not shift further in its benefit in the coming year.

Opposing Positions

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their reason to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, progressively conceding lives and land but preventing a total frontline collapse until situations evolve in its benefit.

Present Conditions

Objectively, there are no real preconditions for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any proposal Kyiv finds unacceptable, so that their focus does not shift toward homefront challenges. And although their task will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the other European countries, along with calming attempts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new plans based on established approaches are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and show certain reluctance to change the course of events, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, primarily depend on ongoing international assistance.
